Terms & Conditions for Align Meet Solutions Timo Behrens ("trakkd")

By accessing or using the "trakkd" meeting productivity application ("Service"), you agree to these Terms & Conditions. If you do not agree, you must discontinue use of the Service.

The Service is intended for business use by individuals who have registered with a Google or Microsoft account. The Service is intended for business use by individuals aged 18 and older. You are responsible for ensuring that you have permission to use the Service on behalf of the company or entity you represent.

To use "trakkd," you are required to sign up with your Google or Microsoft account. By doing so, you grant us access to your email, first name, last name, profile picture, and calendar data, allowing us to synchronize your calendar events with the Service. Each user may create only one account per company, which is non-transferable.

If you choose to integrate your calendar with "trakkd," the Service may retrieve your calendar events and, with your consent, edit calendar entries (for example, to add a link to meeting notes). To help you save time, "trakkd" may also suggest canceling meetings that lack discussion points and can cancel these meetings upon your approval.

You are responsible for maintaining the confidentiality of your account credentials and all activity occurring under your account. By authorizing calendar integrations, you agree that "trakkd" may act on your behalf to make approved updates.

To prevent trial abuse, your email address is stored as a hash, even after account deletion. This hashed email cannot be reverted to its original form, ensuring privacy and security.

If you wish to delete your account, you have the right to request account deletion in compliance with GDPR's "right to be forgotten." Currently, "trakkd" does not offer a self-service account deletion feature yet, but you may request deletion by emailing [email protected]. Your account and associated personal data will be permanently deleted within three business days of receiving the request, except where retention is necessary to support shared meeting records or assignments, which may be retained to ensure continuity and accountability among meeting participants.

After an optional free trial, continued access to "trakkd" requires a paid subscription. Each account is limited to one trial period. No refunds are offered for subscription fees, as the trial period is intended to allow users to evaluate the Service.

The subscription is billed on a recurring basis according to your selected plan. Pricing and subscription terms are subject to change, and any updates will be communicated to users in advance. Your continued use of "trakkd" after any pricing changes constitutes acceptance of the new pricing.

You agree to use the Service in compliance with all applicable laws and these Terms. Any account associated with unlawful activities, malicious behavior, attempts to bypass security measures, spamming, harassment, or any behavior that disrupts the Service or other users may be suspended or terminated without prior notice. Align Meet Solutions Timo Behrens reserves the right to block, close, or delete accounts in such cases.

"trakkd" allows users to create and share meeting notes, discussion points, comments, decisions, and other related information to support collaborative work. By default, all content created in connection with a meeting is shared with the meeting participants as indicated by your calendar events. If a meeting participant does not have a "trakkd" account, meeting notes may be shared via email or other communication channels.

If a meeting participant creates a "trakkd" account after meeting notes have been created, they may gain access to those meeting notes if they are listed as an attendee in the calendar event.

Notes marked as "private" will remain visible only to the user who created them. Private notes are permanently deleted upon account deletion by the user, ensuring exclusive user control over such content.

We collect personal and business information necessary to provide and maintain the Service, including access to your calendar to synchronize meeting notes and events. Additionally, users may provide optional feedback to help us improve the product. You may also opt-in to receive marketing emails and product updates.

"trakkd" sends essential transactional emails, such as meeting notes, meeting reminders, and reminders to add discussion points, to support your use of the Service.

We use Stripe as a payment processor to handle subscription payments. For compliance and record-keeping purposes, we store invoices containing personal information for up to 10 years. All personal data related to invoicing and billing is handled securely and in line with GDPR and applicable financial regulations.

We strive to ensure the continuous availability and reliability of the Service. From time to time, we may release updates, enhancements, or patches to improve functionality or address security vulnerabilities.

Align Meet Solutions Timo Behrens reserves the right to apply such updates without prior notice to maintain the security and integrity of the Service. While we prioritize addressing critical vulnerabilities promptly, we do not guarantee the resolution of all security issues within a specific timeframe.

Align Meet Solutions Timo Behrens is committed to following data protection best practices and strives to comply with GDPR in handling personal data. To support our Service, we work with trusted third-party providers to securely process and store data. All servers processing user data are located within the EU to align with European data protection regulations.

While we strive to provide a reliable Service, you agree that Align Meet Solutions Timo Behrens is not liable for any direct, indirect, incidental, or consequential damages arising from:

• Downtime, technical issues, or interruptions of the Service
• Data loss or unauthorized access to user data
• Misuse of the product or inability to use the Service

The Service is provided on an "as-is" basis, without warranties of any kind, express or implied. To the fullest extent permitted by law, Align Meet Solutions Timo Behrens' total liability for any claims arising out of or relating to this Agreement or the use of the Service shall not exceed the total amount paid by you for the Service in the last 12 months.

You agree to indemnify and hold harmless Align Meet Solutions Timo Behrens from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

Any disputes arising from or related to the use of the Service will be governed by German law. You agree that any claims or legal proceedings will be resolved exclusively through the competent courts located in Berlin, Germany.

Prior to initiating any legal proceedings, the parties agree to attempt to resolve the dispute amicably through mediation or arbitration. If mediation or arbitration is not successful, either party may then proceed with litigation.

Any claims or actions arising out of or related to these Terms must be filed within one year from the date of the incident giving rise to the claim.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

These Terms constitute the entire agreement between you and Align Meet Solutions Timo Behrens regarding the use of the Service and supersede any prior agreements or understandings.

Align Meet Solutions Timo Behrens reserves the right to update these Terms at any time. Users are encouraged to review the Terms periodically for any changes. Continued use of the Service following any changes constitutes acceptance of the new Terms.
